Terms and Conditions


General

 

These terms and conditions (“Online Store Terms”) apply to all transactions concluded with you, the customer, when you shop via the Mull Pottery website and the online store. Please read them carefully before placing your order and print a copy for your future reference. By registering at the online store you accept and agree to be bound by the Online Store Terms and the terms and conditions of the Website which together shall constitute the entire agreement between you and Mull Pottery & Gallery.

 

Mull Pottery & Gallery reserves the right to alter these Online Store Terms from time to time.


The Online Store Terms are subject to Scottish Law and the exclusive jurisdiction of the Scottish courts. If any Online Store Terms shall be deemed unlawful, void or for any reason unenforceable then that Online Store Term shall be severable and shall not affect the validity and enforceability of the remaining Online Store Terms.

 

Acceptance of orders

Mull Pottery & Gallery are only able to take orders through the online store for delivery to the UK & EU
for orders outside these regions contact Mull Pottery. 
 
Mull Pottery validate your order and credit or debit card details you submit to us before your order can be accepted. Once that has been done, Mull Pottery will confirm that your order has been received by sending an e-mail to the e-mail address you provide in your registration form. Our confirmation of your order brings into existence a legally binding agreement between us.

Mull Pottery accept all orders for products and services subject to availability and certain security checks. 

Mull Pottery accept payment by most major credit and debit cards. Payment will be debited from your account before the dispatch of your purchase. All credit and debit card holders are subject to validation checks and authorisation by the card issuer and Mull Pottery.  Mull Pottery will not be liable for any delays to your order this may cause. If the issuer of your payment card refuses to authorise payment to us or you fail our security checks, Mull Pottery will not be liable for any delay or non-delivery.

 

Availability of Products

If online store products become temporarily unavailable, Mull Pottery shall hold your order until Mull Pottery has the product back in stock and will then mail the product to you in the usual way. In the event that an individual product becomes permanently unavailable then Mull Pottery will seek to offer you a suitable alternative or give you a full refund.


 

Colour reproduction

 

Mull Pottery has made every effort to reproduce colours in the online store as accurately as possible. However, different computers reproduce colours in slightly different ways, and so exact colour matches are not yet possible over the internet. This means that when you order products from the online store, colours may differ from what you see on the screen. If you are not satisfied with the colour of the product you have ordered, Mull Pottery operate a returns policy contact Mull Pottery.
 

Products and Pricing

All product prices include Value Added Tax (“VAT”) where applicable. These may change in line with UK government, Customs and Excise, EU directives, and other legal interpretations issued by relevant authorities. 

 

Import duties and local taxes are NOT included in the quoted price of goods being delivered to outside the EU. You will be responsible for the paying of any and all import duties and local taxes including any administration charges upon receipt.

 

Mull Pottery reserve the right to amend any prices without any prior notice and at any time and the right to add or withdraw any product at any time.

Guidance

To the extent that  are permitted by law to limit our liability to you in connection with any order, that liability will not exceed the total price charged for the relevant product(s).

Delivery

Your order will normally be dispatched within 5 (five) working days of placing the order. Whilst Mull Pottery make every effort to deliver goods within such timescales, however, some delays are inevitable. Mull Pottery shall not be liable for any delay that you may suffer in this regard.  

Cancellation/Returns Policy

Mull Pottery have the right to cancel any order you make for any product if you fail our validation or security checks. In certain instances you may not receive email confirmation of an order being cancelled.  If payment has been processed you will receive a full refund. 

 

You have the right to cancel any order you make for any product (other than personalised products) purchased through the online store for a full refund. If for any reason you are not satisfied with your purchase, return it to us within 14 (fourteen) days of receipt in an unworn/unused condition for a full refund or exchange. When returning products to us for refund or exchange, you must pay for the appropriate postage costs. Full orders returned from UK customers will receive a full refund including postage charges.

Please wrap products securely, and attach appropriate postage. Mull Pottery advise that returns are sent recorded delivery via Royal Mail as Mull Pottery will not accept liability for lost returns.  In the instance Mull Pottery are liable for return postage costs Mull Pottery will not refund return postage above or beyond the inital postage charge.  Should you have any queries regarding a contact Mull Pottery. 


 

Credit and Debit Card Security Assured

This online store uses the latest 128bit security encryption to protect your personal information. When you enter your personal details in the checkout pages you are in a secure web site.

 

Transactions also require the use of the security code (CV2) number from the back of your credit or debit card. This information is only available with physical access to the card and is not stored by the web site.

 

Mull Pottery will take all reasonable care to keep the details of your order and credit card information secure but unless Mull Pottery have been negligent, Mull Pottery will not be liable for any losses you may suffer as a result of unauthorised access by a third party to the information transmitted by you when ordering products or services from the online store.

The above terms do not affect your statutory rights.

 

Third Party Rights

The Online Store Terms are not intended to give rise to any right which is enforceable by a third party by virtue of the Contracts (Rights of Third Parties) Act 1999.
